Introduction

Welcome to Nifty Gifts (the "Service"), provided by Solid Core Ventures Pty Ltd ACN 690 836 812 ("we", "us", "our"). The Service helps individuals, families, friends, clubs, community groups, classrooms, and workplace teams plan gifts and shared needs using collaborative, privacy-aware wish lists. This includes creating and sharing lists, capturing gift ideas and product links, and coordinating purchases (for example reducing the chance of duplicate gifts), through our website and browser extensions.

These Terms and Conditions ("Terms") set out your rights and obligations when using the Service.

If you install our browser extensions from an extension gallery, your use is also subject to that platform's terms, for example the Chrome Web Store Terms of Service (and equivalent terms for other browsers' stores where we distribute extensions).

Acceptance of Terms

By using the Service, you agree to these Terms. If you do not agree, you must stop using the Service.

Account age and children

You must be at least 13 years old to create your own Nifty Gifts account. If you are not yet legally an adult where you live, you must have permission from a parent or legal guardian to create and use your account.

A parent or legal guardian may use their own account to create and manage a wish list for a child under 13. The adult account holder is responsible for the content added and how the list is shared, and should avoid including unnecessary sensitive or identifying information about the child.

Service Description

The Service lets you create and manage wish lists, share them with people you choose, add items (including notes and links to third-party retailers), and use collaboration features such as reservations or purchase coordination where available.

Third-party sites and products. Wish lists may contain links to merchants or other websites we do not control. We do not endorse those sites, guarantee product availability, pricing, shipping, or accuracy of listings, and we are not responsible for transactions you make with third parties.

Affiliate disclosures. Some product links may be monetized through affiliate routing before you reach a retailer, and we may earn a commission at no extra cost to you. See Affiliate / Monetization Disclosure below and our Privacy Policy for details.

You may use the standard Service for personal, family, social, community-group, club, classroom, and internal workplace gift planning. Clubs and community groups may also coordinate shared equipment, event supplies, and similar group needs.

Internal workplace use is allowed even where the workplace is a business, provided the Service is used for staff or team planning rather than sold, supplied, or operated as a product or service for customers.

Affiliate / Monetization Disclosure

Nifty Gifts is offered without a subscription fee. To help cover operating costs, we may earn a small commission when you complete a purchase after following a product link from a wish list to a participating retailer, at no extra cost to you.

As an Amazon Associate, Nifty Gifts earns from qualifying purchases.

Eligible non-Amazon links may route through an affiliate partner before you reach the retailer's website. Affiliate attribution and any partner-side cookies are handled on third-party domains after you leave our site.

Retailers set their own prices, availability, checkout flows, shipping, returns, promotions, and whether a transaction qualifies for commission. We do not operate third-party stores and are not responsible for their inventory, checkout experience, or purchase decisions.

Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates. Other retailer and partner names or marks belong to their respective owners. Product links and affiliate routing do not mean that Amazon or any retailer sponsors, endorses, or is affiliated with Nifty Gifts unless we expressly say so.

Consumer Rights

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL). If there is a conflict between these Terms and your statutory rights, your statutory rights will apply.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service, our website and browser extensions, on devices you own or control, for the permitted personal, family, group, club, classroom, and internal workplace planning described in these Terms.

This licence does not permit you to resell, sublicense, commercially exploit, or repackage the Service; operate it on behalf of customers; or use it for bulk marketing, advertising, or lead generation, unless we expressly agree otherwise in writing.

Where you obtain an extension through an extension gallery, your use is also subject to that platform's usage rules.

Extension galleries

If you install our extensions from a browser's extension store, you must comply with that store's terms. The extension platform operator is not responsible for the Service or its content, is not obliged to provide maintenance or support for our software, and, to the extent permitted by law, may be a third-party beneficiary of these Terms with rights to enforce relevant provisions.

We are responsible for supporting Nifty Gifts as described on our website or in-product help. Platform operators are not obliged to provide maintenance or support for our software.

User Obligations

When using the Service, you agree to:

• Provide accurate information where you choose to provide it;
• Use the Service only for the personal, family, group, club, classroom, and internal workplace planning permitted by these Terms;
• If you use the Service for a club, community group, classroom, or workplace, follow any applicable organisational policies and obtain any permission reasonably required to create or share the list;
• Keep your login details secure and notify us of unauthorized access;
• Not misuse the Service (including attempting to access others' data without permission, disrupting the Service, or using extensions or automation in a way that violates applicable laws or third-party sites' terms);
• Respect the privacy and preferences of people you invite or share lists with.

We handle personal information as described in our Privacy Policy.

Acceptable use

You must not use the Service for unlawful purposes or to facilitate illegal activity. Without limiting the foregoing, you must not use the Service to violate applicable laws, infringe others' intellectual property or privacy rights, harass or harm others, distribute malware, attempt unauthorized access to our systems or other users' data, or circumvent security or usage limits except as expressly permitted.

Your content and license to us

You retain ownership of content you create and submit to the Service, such as wish list titles and settings, notes you write, and photographs you upload ("your content").

To operate Nifty Gifts, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and communicate your content (including to people you choose to share with, and to subprocessors that provide infrastructure we need), solely to provide, secure, and improve the Service. This license lasts until you delete the relevant content or your account, except where we retain copies briefly for backups, legal compliance, or dispute resolution as described in our Privacy Policy.

Third-party products and retailers. Product names, branding, images, and descriptions on retailer or manufacturer sites are owned by those third parties or their licensors. Adding a link, title, or note that refers to a product does not give you ownership of any third-party intellectual property. You are making a reference for the gift-planning or group-planning purposes permitted by these Terms. We do not claim ownership of third-party materials; those rights remain with their owners.

You are responsible for ensuring you have the rights you need for anything you upload or submit (for example photos you took yourself or have permission to use). If you include material you did not create, you represent that your use on the Service is permitted.

Infrastructure and Geographic Scope

The Service may be hosted and processed in the United States and other locations, as described in our Privacy Policy. Regardless of where data is processed, these Terms are governed by the laws of Tasmania, Australia (see Governing Law below).

Nifty Gifts is available on the open internet. You are responsible for ensuring your use complies with laws where you live. References to Australian consumer rights apply where the ACL applies to you.

Intellectual Property

All intellectual property rights in the Service are owned by us or our licensors. You receive only the limited license above.

Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you agree to that policy.

Disclaimer of Warranties and Liability

• The Service is provided on an "as is" basis. We use reasonable efforts to operate reliably but do not guarantee uninterrupted availability or error-free operation.
• To the fullest extent permitted by law, we exclude warranties not expressly stated in these Terms.
• Where liability cannot be excluded under the ACL, our liability is limited (at our option) to re-supplying the affected service or refunding fees paid for it in the relevant period.
• Otherwise, our total liability to you in connection with the Service is limited to the amount you paid us for the Service (if any) in the six months before the claim arose.
• We do not guarantee that extensions will always remain listed in any store; availability may change.

Indemnity

You agree to indemnify us against third-party claims arising from your misuse of the Service or breach of these Terms, except where we have acted negligently or unlawfully.

Termination

You may close your account at any time where the product allows it.

We may suspend or terminate access if you materially breach these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will give prior notice.

Dispute Resolution

Contact us first so we can try to resolve concerns informally.

If a matter cannot be resolved, it will be resolved by binding arbitration in Tasmania, Australia, unless otherwise required by law.

Updates to the Service and Terms

We may update the Service and these Terms. We will notify you of material changes where appropriate; continued use after notice may constitute acceptance.

General Provisions

• Entire agreement: These Terms are the entire agreement between you and us regarding the Service.
• Severability: If a provision is invalid, the remainder stays in effect.
• No waiver: Failure to enforce a provision is not a waiver.

Governing Law

These Terms are governed by the laws of Tasmania, Australia.
